Our Partnership

Wyndcroft (the “School”) and your family share a purpose: providing a safe, joyful, challenging education where students are known and supported. This agreement sets the financial and legal terms of enrollment and points to the policies (our Handbooks and published procedures) that help our community work well together. When questions or concerns arise, we ask families to bring them promptly to the appropriate school leader so we can resolve them in good faith.

1) Parties; Term

This agreement is between The Wyndcroft School and the Parent/Legal Guardian(s) (“Parent/Guardian,” singular or plural) of [Student Name] (“Student”) for the 2026–2027 school year only. It does not assure enrollment in future years. The School’s Student and Family Handbooks, Code of Conduct, and published procedures (collectively, the “Handbooks”) are incorporated by reference and may be reasonably updated during the year; Parent/Guardian and Student agree to comply with them.

2) Annual Tuition Commitment, Fees, Payment Plans; Tuition Refund Plan (TRP)

Tuition & Fees. [2026–2027] tuition and fees for each grade are published with the offer of enrollment and on the School’s website. Parent/Guardian understands that there may be additional fees during the Student’s enrollment, such as for participation in field trips.

Deposit. A $750 non-refundable deposit per student, applied to tuition, is due upon signing.

Please note that all invoices are emailed from FACTS, our tuition management partner, based on the payment plan selected above.

FACTS Authorization. Parent/Guardian maintains an active FACTS account, keeps payment methods current, and pays any returned-payment/platform fees.

Past-Due Accounts. Accounts 30+ days past due may incur 1.5%/month interest and late/returned-payment fees; at 90+ days past due, the School reserves the right to accelerate the total unpaid balance of tuition and fees, and refer the account for collection.

Annual Obligation. Enrollment at The Wyndcroft School represents a full-year commitment. Once this agreement and deposit are submitted, the full year’s tuition and fees are owed as liquidated damages if the Student withdraws, is absent, or is dismissed for any reason, except as allowed in Section 5. This amount represents the parties’ reasonable pre-estimate of the School’s losses, including loss of budgeted revenue, administrative costs, and the inability to fill a vacated space after the academic year begins.

Dewar’s Tuition Refund Plan is governed solely by Dewar; the School is not the insurer. Claim proceeds are applied to Parent/Guardian’s account in this order: (1) outstanding tuition/fees; (2) restoration of institutional aid/scholarship; (3) any remainder to Parent/Guardian. TRP may not cover all amounts; Parent/Guardian remains responsible for any unpaid balance.

3) Financial Aid / Scholarships

Aid decisions are annual. Regardless of aid, Parent/Guardian remains primarily responsible for all obligations. If enrollment ends early, amounts owed are determined under Sections 2 and 5 and any TRP benefits.

4) Educational Program; Placement

Class/grade placement, curriculum, schedules, personnel, teaching methods, and learning locations (on-campus, hybrid, or distance) are set at the School’s discretion. The School does not guarantee specific outcomes beyond what is described in its program and policies. The School strives to keep publications accurate, but programs, staffing, and details may change; families should confirm material terms with the Admissions Office. Only the Head of School (or designee) may make commitments that modify standard programs or arrangements.

5) Withdrawal Deadlines (Parent/Guardian‑Initiated)

To withdraw without further tuition obligation beyond amounts already due as of the date below, Parent/Guardian must email the Director of Admission at hwalker@wyndcroft.org and receive confirmation by June 30, 2026. Notices must include the Student's name and the effective withdrawal date. Absent a court order, both legal custodians must consent. After June 30, 2026, the full year tuition and fees are due (TRP may apply if elected).

6) Enrollment Standards & Community Conduct (Student & Family)

A positive, constructive relationship among families and the School is essential. The School may impose restrictions, suspend, or dismiss a Student where, in the School’s reasonable discretion:

Student or Family violates School policies or engages in behavior that undermines safety, learning, or community well‑being (on campus, at School events, or online);
Parent/Guardian’s conduct (e.g., threatening, harassing, or persistently undermining School policies or personnel; initiating or threatening legal action without first engaging the School’s resolution process) materially interferes with School operations;
Material misrepresentations/omissions occur in admissions, aid, or School processes;
Student’s needs cannot reasonably be met within the School’s program; or
Accounts are seriously delinquent.

There is no refund in these circumstances and any unpaid balance remains due. For purposes of this section, “threatens litigation” includes any claim, proceeding, or action for which a demand or notice has been made (orally or in writing), or other circumstances that would lead a prudent person to conclude such a matter is likely to be asserted or pursued. Parent/Guardian authorizes the School to provide, at its discretion, information about discipline, suspension, or dismissal to another educational institution to which the family applies; Parent/Guardian waives and releases any claims arising from such disclosures and agrees to indemnify the School against any related claims.

7) Records, Access, and Account Holds

All accounts for all enrolled siblings must be current before records/transcripts are released or a student may begin/continue attendance. See Section 2 for interest, acceleration, and collection terms.

8) Health & Safety; Authorizations

Parent/Guardian maintains comprehensive health insurance for the Student and provides documentation upon request. Parent/Guardian authorizes routine care by the School nurse or trained personnel per the Student’s care plans; Parent/Guardian agrees to reimburse out-of-pocket medical expenses advanced by the School. The School may require evaluation/therapy and reciprocal releases as a condition of continued enrollment when reasonably necessary for safety and access; School health protocols for Parent/Guardian notification in the Handbooks will be followed.

9) Publicity & Student Work

Unless Parent/Guardian opts out in writing to hwalker@wyndcroft.org, the School may use the Student’s name, image, voice, and schoolwork for educational, community, and promotional purposes in School media; opt-outs will be honored prospectively and reasonably.

10) Directory Information

The School may provide family contact details to current School families for community use (not commercial or political). Parents/Guardians may request exclusion by emailing lneiman@wyndcroft.org before the first day of school.

11) Personal Information & Disclosures

Parent/Guardian consents to the School’s collection and use of Student/Parent/Guardian information as needed to operate the program, meet legal obligations, and engage third-party service providers (e.g., FACTS) under appropriate safeguards. The School may disclose records as authorized by law or with Parent/Guardian consent, or when reasonably necessary to protect safety.

12) Program Changes & Force Majeure

Events beyond the School’s control (e.g., natural disaster, government orders, public health emergencies, utility failures) may require changes to delivery (calendar, modality, schedule). During a force-majeure event, the School may require a separate waiver of liability as a condition of the Student’s on-campus participation. 13) Dispute Resolution; Governing Law; Jury Trial Waiver

Before filing suit, Parent/Guardian agrees to first raise concerns with the Head (or designee) for good-faith resolution. This agreement is governed by Pennsylvania law; exclusive venue lies in Pennsylvania state/federal courts. The parties waive the right to a jury trial for any dispute arising from or relating to this relationship.

14) Notices

Notices. Email to hwalker@wyndcroft.org (Parent/Guardian → School) and to the primary email(s) on file (School → Parent/Guardian) is effective upon sending; certified mail may be used when required by law. The School will acknowledge receipt of Parent/Guardian withdrawal emails.
Entire Agreement; Amendments. This is the entire agreement and may be amended only in a signed writing by the School and Parent/Guardian. Handbooks and published policies are incorporated by reference and may be reasonably updated during the year.
Conflict Control. If a conflict exists between this Agreement and the Handbooks, the Handbooks control.
Severability; No Waiver. If any provision is unenforceable, the remainder remains effective. A failure to enforce any term is not a waiver.
Assignment. The School may assign this Agreement to a successor entity; Parent/Guardian may not assign obligations without the School’s consent.
Third-Party Beneficiaries. There are no third-party beneficiaries to this Agreement except the School’s officers, trustees, employees, and agents where expressly stated.
Headings & Construction. Headings are for convenience only. “Including” means “including without limitation.” This Agreement will not be construed against a drafter.
Survival. The following survive termination or expiration: tuition/fees and TRP payoff order; records/holds; publicity & student work; personal information; governing law/venue; jury-trial waiver; notices; severability; no waiver; assignment; and this survival clause.

15) Student’s Satisfactory Completion of the Prior School Year

This agreement is conditioned on the Student successfully completing the prior school year in good standing, academically and behaviorally. If the School determines in its sole and reasonable discretion that this requirement was not met, the School may cancel this agreement and will refund tuition paid; fees designated non‑refundable remain non‑refundable.

16) Medical and Counseling Authorizations and Consents

Parent/Guardian authorizes routine care (including administration of allergy medications, Epi‑Pens, etc. per prescriptions) by the School nurse or trained personnel. The School may require evaluation/therapy with reciprocal releases as a condition of continued enrollment when reasonably necessary. By executing this agreement, Parent/Guardian authorizes the School’s student guidance counselor to meet with and counsel the Student regarding emotional, social, or family circumstances. Parent/Guardian hereby releases and holds the School harmless from any liability which might arise from the provision of such medical care or counseling services. Parent/Guardian agrees to reimburse the School for any medical expenditures made on the Student’s behalf.

17) Entire Agreement; Notices; Miscellany

This Agreement sets forth the entire understanding of the parties hereto with respect to the subject matter hereof and may be modified only in a writing signed by all parties. This Agreement merges and supersedes all prior and contemporaneous oral and written understandings between the parties respecting the matters within its scope. There have been no representations

18) Required Signatures and Representations

The submission of the Enrollment Agreement with the signature of a single Parent/Guardian constitutes the representation of the signing Parent/Guardian that he/she has the necessary authority and consent to sign on behalf of the other Parent/Guardians. A Parent/Guardian who signs on behalf of other Parent/Guardians confirms he/she has authority and consent. Signing without authority and consent constitutes fraud.

SCHOOL AND PARENT/GUARDIAN UNDERSTAND THAT THIS AGREEMENT REQUIRES BOTH SCHOOL AND PARENT/GUARDIAN (ON PARENT/GUARDIAN’S BEHALF AND ON BEHALF OF STUDENT) TO GIVE UP RIGHTS TO TRIAL BY JURY.

Parent/Guardian understands and agrees that if this Enrollment Agreement is signed electronically, a photocopy or an electronically signed version is an acceptable substitute for the original and holds the same force and effect as a wet ink signature.
